Your Booking with The Argyll Club 

Thank you for choosing The Argyll Club for your booking.  

In paying for your booking you acknowledge that you have read and fully understood the following terms and conditions (“T&C’s”) and the you expressly consent and agree to be bound by the T&C’s and all applicable laws and regulations that govern your booking. 

These T&C’s are governed by the laws of England and Wales. If any provision of the T&C’s is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provision of the T&C’s, which shall remain in full force. 

To make these booking T&C’s easier to read, we use several definitions: 

“Building” is The Argyll Club building to which the booking applies, 

“Residential, Virtual or Co-working and Lounge Member” is a person, organisation or company responsible for the booking, that has a contractual membership with The Argyll Club 

“External Member” is a person, organisation or company responsible for the booking that does not have a contractual membership with The Argyll Club 

“Booking” is the request for Day Office, Meeting Room or other Event space in an Argyll Club building, 

“Additional Services” are optional services that are offer by The Argyll Club that can be booked in advance or requested on the day of the booking. 

“Website” being The Argyll Club’s main online site www.TheArgyllClub.com  

 

Prices, bookings & payments (External Members) 

 

All prices quoted are subject to VAT if appropriate at rates prevailing at that time. By making a booking you are responsible for making all payment due under the booking. A contract between you and The Argyll Club will exist when we receive payment following your receipt of the booking confirmation form by email. If you have not received a booking confirmation within 24 hours of requesting a booking, please notify us as soon as possible using the details on our contact us page. Please check your booking confirmation carefully and report any incorrect or incomplete information to us prior to your booking date. 

Where applicable the Member must be authorised to make the booking on behalf of the organisation or company and the Member must be over the age of 18 years old at the time of making the booking. By making the booking you are confirming that you are over 18 years old and that you have the right to make a booking on behalf of the Member. 

Payment(s) for the booking are due upon receipt of the booking confirmation form via email. We request that all payments are made electronically via the payment link in the booking confirmation form sent. Any charges for additional services or extensions to the booking will be added to the final invoice to be settled on the day of the booking or in advance if requested by the Member.  

 

Prices, bookings & payments (Residential, Virtual and Co-working and Lounge Members)

Where applicable the Member must be authorised to make the booking on behalf of the organisation or company and the Member must be over the age of 18 years old at the time of making the booking. By making the booking you are confirming that you are over 18 years old and that you have the right to make a booking on behalf of the Member. 

Payment(s) for the booking are charged on account at the point the booking confirmation form is sent via email. Payments for bookings and any charges for additional services or extensions to the booking will be added to the Members next monthly invoice to be settled in line with their agreed payment terms. 

 

Booking amendments and cancellations  

 

While The Argyll Club tries to support all our Members requesting booking amendments, we regret that we cannot always accommodate them if they are provided less than 3 working days prior to the booking date. Should you wish to cancel your booking The Argyll Club reserves the right to charge a cancellation fee in respect of the below terms: 

  • Where the cancellation is 3 or less working days prior to the booking date we reserve the right to charge 100% of the booking fee as a cancellation charge, 

  • Where the cancellation is 4-5 working days prior to the booking date we reserve the right to charge 75% of the booking fee as a cancellation charge, 

  • Where the cancellation date is 6-10 working days prior to the booking date we reserve the right to charge 50% of the booking fee as a cancellation charge, 

  • All cancellations made at least 10 working days prior to the booking date will not be subject to a cancellation charge. 

Any booking cancellation or amendment request should be addressed directly to The Argyll Club using the contact details provided in your booking confirmation. We recommend that you keep all confirmations of booking cancellations or amendments until after the date of the booking. If you are a Club Member of the Argyll Club the above cancellation terms will be superseded by the terms provided in your Welcome Handbook and can be confirmed with your Building General Manager at any time. 

The Argyll Club are not liable for refunds or expenses the Member may incur in the event they are prevented from fulfilling your booking as a result of circumstances beyond their control. Such circumstances shall include (but will not be limited to) war, terrorism, civil unrest, industrial action, natural disasters, epidemics, or such similar events (“Force Majeure”). 

 

Terms of use 

 

When a Member utilises a Day Office, Meeting Room or Event space The Argyll Club requests that for the benefit of all Members the Member agrees to the following: 

  • All areas within all Argyll Club buildings are non-smoking, 

  • We request that Members do not bring in food or beverages, with the exception of personal lunches or similar for Day Office bookings, from outside the building without prior consent. Should consent be granted we reserve the right to charge a corkage fee in respect of external catering or the consumption of alcoholic beverages. 

  • To the extent permitted by law The Argyll Club does not accept any responsibility for the loss of or damage to any items brought into the building by a Member. 

  • The Argyll Club’s standard hours of service are Monday to Thursday from 8:30am to 5:30pm and on Friday’s from 8:30am to 5pm. Access to the building outside of these hours must be pre-arranged and where applicable subject to an additional fee for service. 

  • Members will have access to the booked space 15 minutes prior to the booking time, subject to availability. Should you require earlier access this can be pre-arranged at the time of the booking and maybe subject to an additional fee. 

  • Should a booking exceed the end time of the booking The Argyll Club reserves the right to charge an additional fee for the extra usage inline with our standard pricing. While we always try to operate with discretion, we reserve the right to politely remind Members whose bookings have overrun to ensure availability for other Member bookings. 

  • All Day Offices, Meeting Room’s or Event spaces are to be returned in the state that they were made available, we reserve the right to charge for any damages caused during or related to the booking above wear and tear. 

The Member will, as far as legally allowed, indemnify The Argyll Club against all costs, loss, damage or injury sustained due to the act, neglect or default of the Member or any guest for whom the Member is responsible. 

 

Acknowledgements 

 

You hereby acknowledge and agree that: 

  • Your have read The Argyll Club’s Privacy Policy and consent to the data processing outlined in that policy. In making a booking you will be asked to submit personal information about yourself to allow us to provide services. Whenever you provide such personal information we will store and process it in accordance with our privacy policy. 

  • You are making the booking in the context of a business service, should this not be the case we request that you contact us prior to making your booking to agree the service to be provided. If a booking has been made and in the event that The Argyll Club does not accept this type of service, then the booking maybe cancelled and cancellation fees may apply. 

  • We will not be liable for any changes or cancellations to your booking, nor for loss or damage suffered by you or for any failure by The Argyll Club to perform any of our respective obligations to you caused by force majeure or any other unforeseen circumstances beyond our control. 

  • You have read The Argyll Club’s statement in respect of our Covid-19 response which can be found on the contact section of our Website and through it our guidelines on zjw?>~&]~o|Po}Making it work, together which we do request all Members adhere to during this difficult times to ensure the safety of all of our Member and Staff. 

 

Data protection 

 

For the purposes of data protection legislation for data relating to your booking (“Personal Data”), we are the Data Controller and Processor. As per our Privacy Policy we will retain any personal data collected for no longer than is reasonably required. 

 

Limitation of liability 

 

In no event shall The Argyll Club or its owners, officers, directors, agents and/or employees be liable for any costs, loss of profits, loss of contract or any indirect, consequential, special or incidental losses, data loss or corruption or punitive damages arising out of, based on, or resulting from your use of the booking services, even if The Argyll Club has been advised of the possibility of such damages. 

These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence, or any other cause of action. If you are dissatisfied with the booking service or you do not agree with any part of these T&C’s, then your sole and exclusive remedy against The Argyll Club is to discontinue using the services. 

Subject to the limitations set out in these T&C’s and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your booking. 

If any part of these T&C’s limiting or excluding liability is held by a court to be unreasonable or inapplicable, the other parts shall continue to apply. 

Nothing in these T&C’s shall exclude or restrict The Argyll Club’s liability for death or personal injury resulting from its negligence, nor for The Argyll Club’s fraud or fraudulent misrepresentation.
